The links and information below are meant to help brokers and licensees understand the various legal, regulatory and ethical issues that impact how brokerage fees are charged.  There is no intent to provide information or advice on how brokers should determine what fees to charge to their clients.
 
A court case called Busby v. JRHBW Realty, Inc. d/b/a RealtySouth, decided in the Northern District of Alabama in April 2009, may affect how certain brokerage fees are charged and accounted for.
 
Includes analysis of primary issues, comparison of how PAR Standard Forms language compares to the forms in this case, and an explanation of the proper way to fill out the HUD-1 form in certain transactions.
