INTERPRETATIONS OF COMMISSION LAW & REGULATIONS
The Pennsylvania Real Estate Licensing and Registration Act, and the Rules and Regulations promulgated by the Pennsylvania Real Estate Commission are quite extensive and address most aspects of real estate practice in Pennsylvania. As with any statute or regulation, however, some questions are left unanswered or, at least, remain unclear. These ambiguities are most often resolved by the courts, during civil lawsuits, or by the Commission, through disciplinary hearings. REALTORS®, however, want to know if their actions are permissible before they take them because they wish to avoid the costly process of litigation and disciplinary proceedings.
The Pennsylvania Real Estate Commission does not offer formal "advisory opinions"; however, upon request, it periodically provides "interpretations" of the Act and its regulations. This site is designed to provide you with the Commission's "interpretations" for some of the many questions posed by PAR’s counsel, and it will be updated as additional questions and interpretations become available.
