Fraser v. 301-52 Townhouse Corp.
New York Times article | Copy of Text of Decision
The plaintiff in this case filed suit against the owner of a co-op building, claiming that mold growth around windows caused certain health problems.  Before going to trial, the Court held a hearing to determine whether a linkage between mold and health issues was "generally accepted" as a scientific theory.  After reviewing over 1000 pages of research from 70 studies, the Court held that there was not sufficient scientific consensus to justify a trial. NOTE: This case does not mean that mold does not cause health issues, nor does it mean that a court in Pennsylvania would reach the same conclusion.
